These Terms of Use ("Terms") govern your access to and use of the CouchCue mobile application, website, and related services (collectively, the "Service").
CouchCue is owned and operated by 1001612386 ONTARIO LTD., doing business as Motovious App Studio ("Company," "we," "our," or "us").
By accessing or using CouchCue, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
CouchCue helps users discover, organize, track, rate, review, and receive recommendations for TV shows and related entertainment content.
CouchCue may allow you to save titles, track watched history, rate content, write reviews, create private notes, mark favorites, and provide recommendation feedback such as "More like this," "Less like this," "Seen it," and "Not interested."
CouchCue uses third-party metadata sources, including TVMaze, to provide TV show information. CouchCue does not guarantee that metadata, availability, descriptions, release information, or other content information will always be accurate, complete, or current.
CouchCue does not provide streaming, downloading, or viewing access to TV shows. CouchCue is not a streaming service.
2. Eligibility
You must be at least 18 years old to create or use a CouchCue account.
By creating an account or using the Service, you represent that you are at least 18 and legally able to agree to these Terms. CouchCue does not collect your date of birth at launch, but may require you to confirm your eligibility.
3. Accounts And Sign-In
To use certain features, you may need to create an account or sign in using supported methods, including:
- email and password
- Google Sign-In
- Sign in with Apple
You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.
You agree to provide accurate, current, and complete information and to keep your account information updated.
You must not:
- share your account credentials with others
- use another person's account without permission
- create an account using false or misleading information
- attempt to bypass security or access controls
- use the Service for unlawful or abusive purposes
4. User Content And App Data
CouchCue may allow you to submit, create, store, or generate content and app data, including ratings, reviews, private notes, preferences, favorites, watch history, saved titles, and recommendation feedback.
You are responsible for the content and information you submit.
You represent that you have the right to submit any content you provide and that your content does not violate the rights of any third party or any applicable law.
5. Reviews, Notes, And Feedback
CouchCue may include both private and public-facing features.
Private notes are intended to be private to your account unless CouchCue introduces sharing features or you choose to share them.
Shared reviews, ratings, reviewer names, and other community-facing content may be displayed, processed, moderated, hidden, or removed within the Service depending on the features available and our enforcement decisions.
Before publishing a shared review, you must accept the current version of these Terms or the applicable user/content policy. We may retain the accepted version and acceptance time.
You agree not to submit content that is:
- illegal, harmful, abusive, harassing, hateful, defamatory, obscene, or otherwise objectionable
- infringing of intellectual property, privacy, publicity, or other rights
- false, misleading, deceptive, or impersonating another person or entity
- spam, advertising, or unauthorized solicitation
- intended to disrupt, damage, or interfere with the Service
We may remove, hide, restrict, review, or moderate content or accounts that violate these Terms or harm the Service or other users.
The Service may provide controls to report objectionable reviews or users and block review authors. We aim to review reports promptly, but do not guarantee a fixed response or resolution time.
6. License You Grant Us
You retain ownership of content and app data you submit to CouchCue.
By submitting, storing, or creating content through the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, display, moderate, and use that content as necessary to operate, provide, improve, secure, and support the Service.
This license includes using your activity, preferences, ratings, reviews, watch history, saved titles, and feedback signals to personalize recommendations and improve the Service.
7. CouchCue Intellectual Property
The Service, including its software, design, branding, logos, features, functionality, and original content, is owned by or licensed to the Company and is protected by intellectual property laws.
You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract source code from the Service except as permitted by law or with our written permission.
8. Third-Party Services And Content
CouchCue may use, link to, or display information from third-party services, including TVMaze and other providers.
Third-party content and services are not controlled by us. We are not responsible for the accuracy, availability, policies, or practices of third-party services.
Your use of third-party sign-in services, app stores, operating systems, and platforms may also be subject to terms and policies from Apple, Google, or other third parties.
9. Advertising
CouchCue is expected to be free to download and supported by advertising revenue at launch.
The Service may display advertisements, sponsored content, or promotional placements. Advertising may be provided by third-party advertising partners.
We may update the advertising experience over time. Advertising-related data use is described in our Privacy Policy.
10. No Streaming Rights Or Availability Guarantee
CouchCue may help you discover and track entertainment content, but it does not guarantee that any title is available to stream, purchase, rent, or watch in your region.
CouchCue does not own or control the rights to TV shows, movies, or other entertainment content listed in the app.
Any availability information, if provided, may be incomplete, delayed, or inaccurate.
11. Free Service And Future Paid Features
CouchCue is free to download at launch.
We may introduce paid features, subscriptions, in-app purchases, premium services, or other monetization in the future. If we do, additional terms and disclosures may apply.
12. App Stores
If you download CouchCue from the Apple App Store or Google Play Store, your use of the app may also be subject to the applicable app store's terms and policies.
Apple and Google are not responsible for providing support or maintenance for CouchCue, except as required by their applicable rules.
13. Account Deletion
You may request deletion of your CouchCue account and associated data through the app or by contacting support.
When your account is deleted, your right to access the Service under that account will end. Account deletion may be permanent and may result in loss of your saved titles, watch history, ratings, reviews, private notes, preferences, favorites, and recommendation data.

14. Suspension And Termination
We may suspend or terminate your access to the Service if:
- you violate these Terms
- you misuse the Service
- your use creates risk, liability, or harm
- we are required to do so by law
- we discontinue the Service or any part of it
You may stop using the Service at any time and may request account deletion.
15. Disclaimers
The Service is provided "as is" and "as available."
We do not guarantee that the Service will be uninterrupted, secure, error-free, accurate, complete, or available at all times.
We do not guarantee the accuracy, completeness, or reliability of any TV metadata, recommendations, ratings, reviews, availability information, or third-party content.
Recommendations are provided for convenience and entertainment purposes only.
16. Limitation Of Liability
To the maximum extent permitted by law, the Company and its directors, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of use, loss of goodwill, or loss of profits.
To the maximum extent permitted by law, our total liability for any claim related to the Service will be limited to the greater of:
- the amount you paid to use the Service in the 12 months before the claim, if any
- CAD $100
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
17. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its directors, officers, employees, contractors, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from:
- your use or misuse of the Service
- your content or data submitted to the Service
- your violation of these Terms
- your violation of any law or third-party rights
18. Changes To The Service
We may modify, suspend, or discontinue the Service or any feature at any time, with or without notice.
We may also update, change, remove, or limit features, content, recommendations, metadata sources, advertising formats, or supported platforms.
19. Changes To These Terms
We may update these Terms from time to time.
If we make material changes, we may notify you through the app, by email, or by posting an updated version on our website.
Where appropriate, we may require you to accept materially updated Terms before continuing to use affected features, including publishing shared reviews.
20. Governing Law
These Terms are governed by the laws of Ontario, Canada, and the applicable federal laws of Canada, without regard to conflict of law principles. This choice does not limit consumer rights that cannot lawfully be waived in your jurisdiction.
21. Dispute Resolution
If you have a concern or dispute, you agree to first contact us and attempt to resolve the issue informally.

22. Severability
